Terms & Conditions

The terms that apply when using Physique Labz and our online coaching services.

1.

About these terms

These Terms & Conditions govern the use of the Physique Labz website and, where applicable, the provision of online coaching services by PHYSIQUE LABZ LTD.

PHYSIQUE LABZ LTD is a company registered in the United Kingdom under company number 17096378.

By purchasing or using our coaching services, you agree to the terms applicable to those services.

Nothing in these Terms affects any statutory rights that you may have as a consumer.

2.

Coaching services

Physique Labz provides personalised online fitness coaching.

Depending on the coaching service agreed with you, this may include:

  • Personalised training programming
  • Individual nutrition targets
  • Weekly coaching check-ins
  • Progress tracking and programme adjustments
  • Exercise-form feedback
  • Direct coaching support
  • Lifestyle and habit coaching
  • Other agreed coaching services

Personalised meal plans may be available separately or as an additional service where agreed. The exact service provided to an individual client may vary depending on the package or arrangement agreed during consultation and onboarding.

3.

Application and consultation

Submitting a coaching application does not guarantee acceptance as a client.

Applications are reviewed before coaching is offered.

Where appropriate, Physique Labz may arrange a consultation to discuss your goals, circumstances and whether the coaching service is suitable for you.

We reserve the right to decline an application where we reasonably believe the service is not suitable or we are unable to provide the appropriate level of support.

4.

Starting coaching

Where coaching is agreed, the client will complete the required onboarding process and agree a start date.

Physique Labz will then prepare the relevant personalised coaching setup based on information supplied by the client.

Clients are responsible for providing complete and accurate information during application, consultation and onboarding.

The effectiveness and suitability of personalised recommendations depend partly on the accuracy of the information supplied.

5.

Payments

Unless otherwise agreed, coaching operates on a recurring monthly payment basis.

Payments are currently facilitated through Trainerize and its integrated payment processing services, including Stripe.

The price applicable to a client will be communicated before they agree to purchase coaching.

Prices do not need to be displayed on this Terms & Conditions page.

  • Where recurring billing applies, payment will normally be collected automatically at the beginning of each billing period until coaching is cancelled.
  • Alternative arrangements may sometimes be offered, including payment upfront for a longer coaching period, which may be offered at a discounted overall price.

Any specific price, discount, payment schedule or package terms will be communicated before purchase.

6.

Monthly coaching and cancellation

Standard monthly coaching has no minimum commitment unless a different arrangement has been expressly agreed with the client.

Clients may request cancellation at any time.

Cancellation of monthly coaching will normally take effect at the end of the current paid billing period.

Once cancellation has been processed, no further recurring payment will be taken for the following billing period.

Cancelling part-way through a billing period does not automatically entitle the client to a refund for the unused remainder of that billing period, subject always to the client's statutory consumer rights.

7.

Upfront coaching packages

Where a client chooses to purchase a longer coaching period upfront, the price and duration of that arrangement will be made clear before payment.

Any discount applied to an upfront package reflects the longer period being purchased.

Cancellation and refund rights for upfront arrangements remain subject to applicable consumer law and any specific terms clearly communicated before purchase.

Nothing in these Terms removes statutory rights that cannot legally be excluded.

8.

Cooling-off and statutory cancellation rights

Where applicable under UK consumer law, consumers entering into a coaching contract at a distance may have a statutory right to cancel within 14 days without giving a reason.

Where a client asks Physique Labz to begin providing coaching services during this cancellation period, the client expressly requests early performance of the service.

If the client subsequently exercises a statutory cancellation right after service has begun, Physique Labz may be entitled, where permitted by law, to charge an amount proportionate to the services already supplied.

This may include work reasonably undertaken in connection with consultation, onboarding, personalised programme preparation and coaching already delivered.

Nothing in these Terms limits or removes statutory cancellation or refund rights where they apply.

9.

Refunds

Outside any applicable statutory cancellation or refund rights, payments for coaching periods that have already begun are generally non-refundable where the client simply decides not to continue using the service during that paid period.

This reflects the personalised nature of coaching and the work that may already have been undertaken, including onboarding, programme creation, analysis, communication and ongoing coaching support.

This does not affect any legal rights a client may have where services have not been provided with reasonable care and skill, have not been supplied as agreed, or where a refund is otherwise required by law.

Any refund request will be considered in accordance with these Terms and applicable consumer law.

10.

Pausing coaching

Requests to pause coaching may be considered on a case-by-case basis.

This may include circumstances such as travel, injury, illness or significant changes in personal circumstances.

A pause is not automatically guaranteed.

Where a pause is agreed, Physique Labz and the client will confirm how the pause affects coaching access, billing and the client's return date.

11.

Client responsibilities

Clients are expected to:

  • Provide accurate and relevant information
  • Communicate honestly with their coach
  • Complete check-ins where required
  • Inform Physique Labz of relevant changes in circumstances
  • Follow training and nutrition recommendations responsibly
  • Use appropriate judgement when exercising
  • Stop exercising and seek appropriate professional advice where they experience concerning symptoms, pain or injury
  • Seek medical advice where appropriate before beginning or changing an exercise or nutrition programme

Clients remain responsible for their own decisions and actions outside the specific coaching service provided.

12.

Health and fitness disclaimer

Physique Labz provides fitness, training, nutrition and lifestyle coaching.

Unless expressly stated otherwise, coaching is not medical care and is not a substitute for diagnosis, treatment or advice from an appropriately qualified medical professional.

Clients should consult an appropriate healthcare professional where they have a medical condition, injury, symptoms, pregnancy, medication concerns or any other circumstance that may affect their ability to safely follow training or nutrition recommendations.

Clients should disclose relevant information that may materially affect the safety or suitability of their coaching programme.

No part of the Physique Labz service should be interpreted as medical diagnosis or treatment.

13.

Results

Physique Labz aims to provide high-quality personalised coaching designed to help clients make progress towards their goals.

However, individual results vary.

Results depend on numerous factors including adherence, training effort, nutrition, sleep, recovery, lifestyle, starting point, genetics and circumstances outside the control of Physique Labz.

Examples of previous client transformations or testimonials demonstrate individual experiences and do not guarantee that another client will achieve identical or specific results.

No particular weight loss, muscle gain, strength increase, appearance or timeframe is guaranteed.

14.

Communication and support

Coaching communication may take place through Trainerize, WhatsApp, email or another agreed communication channel.

Physique Labz aims to provide responsive support but does not guarantee immediate or continuous availability.

Coaching support is not an emergency service.

Clients requiring urgent medical assistance should contact an appropriate medical or emergency service rather than relying on coaching communications.

15.

Under-18 clients

Physique Labz may provide coaching to clients under the age of 18 where appropriate.

Clients under 16 must have consent from a parent or legal guardian before coaching begins.

Physique Labz may request confirmation of parental or guardian consent and may decline or discontinue coaching where appropriate consent cannot be established.

Additional safeguards or involvement from a parent or guardian may be required depending on the client's age and circumstances.

16.

Intellectual property

Training programmes, coaching materials, written resources, videos, documents, systems and other materials supplied by Physique Labz remain the intellectual property of PHYSIQUE LABZ LTD or the relevant rights holder unless otherwise stated.

Clients are granted permission to use materials supplied to them for their own personal use.

They must not reproduce, distribute, resell, publish or commercially exploit those materials without prior written permission.

17.

Client content, photos and testimonials

Progress photographs, testimonials, messages or other client content will not be used publicly for marketing merely because they were supplied as part of coaching.

Where Physique Labz wishes to use identifiable client content for marketing or promotional purposes, appropriate permission should be obtained from the client.

Any agreed use will be subject to the permission provided and applicable privacy and data-protection requirements.

18.

Suspension or termination of coaching

Physique Labz may suspend or end a coaching relationship where there is a reasonable and serious reason to do so.

Examples may include:

  • Abusive, threatening or inappropriate behaviour
  • Fraudulent activity
  • Persistent non-payment
  • Misuse or unauthorised distribution of coaching materials
  • Circumstances where continuing coaching would reasonably be considered inappropriate or unsafe

Where reasonably possible, the client will be informed of the reason. Any financial consequences of termination will be handled fairly, taking into account services already supplied, payments already made and applicable consumer law.

19.

Service availability

We aim to provide coaching and website services reliably.

However, occasional interruption may occur because of maintenance, third-party platforms, technical problems or circumstances outside our reasonable control.

Where a significant disruption materially affects a paid coaching service, Physique Labz will take reasonable steps to resolve the issue.

20.

Liability

Nothing in these Terms excludes or limits liability where doing so would be unlawful.

Physique Labz does not seek to exclude responsibility for services that must, under applicable consumer law, be performed with reasonable care and skill.

To the extent permitted by law, Physique Labz is not responsible for losses caused by circumstances outside our reasonable control or by a client's failure to follow reasonable safety guidance, disclose relevant information or use the coaching service appropriately.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any other liability that cannot legally be excluded.

21.

Privacy

Personal information is handled in accordance with the Physique Labz Privacy Policy.

22.

Changes to these terms

These Terms may occasionally be updated to reflect changes to our services, business practices or legal requirements.

Any changes will be published on this page with an updated revision date.

Changes will not retrospectively remove rights already acquired by a client under an existing agreement.

23.

Governing law

These Terms are governed by the applicable laws of England and Wales.

Nothing in this section deprives a consumer of any mandatory protections or rights available to them under applicable law.
